These Terms of Use (“Terms”) govern your access to and use of the Formulab AI application and website (the “Service”). By creating an account, subscribing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. What the Service provides

Formulab AI is a software tool that provides AI-generated cosmetic formulation guidance, ingredient information, and related productivity features. It is intended as a professional aid for formulators and is not a substitute for qualified professional, safety, or regulatory advice.

3. Disclaimer — no safety or regulatory assessment

This application and its AI-generated outputs provide formulation guidance only. All information, suggestions, and ingredient assessments are informational and exploratory, and do not constitute a formal safety assessment or regulatory compliance verification.Users remain fully responsible for ensuring that any formulation, ingredient selection, or product concept complies with all applicable cosmetics regulations in their jurisdiction. This includes obtaining a complete Cosmetic Product Safety Report (CPSR) from a qualified safety assessor, conducting stability testing, Preservative Efficacy Testing (ISO 11930), and performing any required clinical or consumer evaluations before placing a product on the market.The AI system may occasionally produce incomplete, inaccurate, or outdated information. Users must independently verify all outputs and conduct their own due diligence. By using this service, you acknowledge that all decisions related to product safety, regulatory compliance, and market readiness are solely your responsibility.

4. Your responsibilities

• You are responsible for the accuracy of information you enter and for how you use any output.
• You must independently verify all AI-generated content before relying on it.
• You are solely responsible for the safety, regulatory compliance, and market readiness of any product you develop.
• You must keep your account credentials secure and are responsible for activity under your account.

5. Accounts, subscriptions and billing

Access to the full Service requires a paid subscription, billed through our payment processor (Stripe). Subscriptions renew automatically until cancelled. You may cancel at any time; access continues until the end of the current billing period. Fees are non-refundable except where required by law.

6. Acceptable use

You agree not to misuse the Service, including by attempting to disrupt it, access it without authorisation, reverse engineer it, or use it to develop products that are unlawful in your jurisdiction.

7. Your content

You retain ownership of the formulas, ingredient data, documents, and other content you create or upload. You grant us a limited licence to process this content solely to provide the Service to you. We do not claim ownership of your formulations.

8. No warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including as to accuracy, fitness for a particular purpose, or non-infringement. We do not warrant that outputs are correct, complete, current, or suitable for any regulatory or commercial purpose.

9. Limitation of liability

To the fullest extent permitted by law, Formulab AI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, product recalls, regulatory penalties, or damages arising from your reliance on any output of the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

10. Indemnity

You agree to indemnify and hold harmless Formulab AI and its operators from any claims, losses, or liabilities arising out of your use of the Service or any product you develop or place on the market.

11. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the law of Scotland, and any disputes are subject to the exclusive jurisdiction of the Scottish courts.
